This document sets out the principles for the processing and protection of personal data of potential and current business partners (in particular clients and suppliers) of MM Investments & Co. sp. z o.o., hereinafter referred to as the Data Controller.

I. Definitions

  1. Cookies - means IT data, in particular small text files, recorded and stored on devices through which the User uses the website of the Service.
  2. Service - means the website owned by the Data Controller.
  3. Device - means an electronic device through which the User accesses the Service.
  4. User - means an entity that uses the content and functionalities available on the Data Controller's websites or for whom, in accordance with the Terms and Conditions and applicable law, services may be provided electronically or with whom an Agreement for the provision of electronic services may be concluded.

In the process of processing personal data, the Data Controller applies the principles defined in the applicable laws, in particular the Act of 29 August 1997 on the protection of personal data and the Regulations of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("GDPR").

IV. Purposes of Data Processing and Retention Period

The Data Controller processes personal data solely for the purpose of acquiring clients/suppliers, carrying out offer processes, order/contract execution, after-sales service of offered goods and services, and sending personalized commercial information, in particular for the purposes of:

  • creating an account on the website
  • personal, telephone, or email contact
  • sending ordered informational, advertising, and promotional materials
  • fulfilling orders/contracts
  • handling service or complaint requests
  • after-sales service
  • potentially pursuing claims
  • adapting websites to the needs of Users
  • creating reports and analyses regarding website functionality, including view statistics

These data will be stored for the period necessary to fulfill contracts, including providing service (warranty and post-warranty). After this period, data will be stored only for the purpose of pursuing claims and sending personalized commercial information.

V. Scope and Method of Data Storage

The Data Controller collects personal data during the process of acquiring a client/supplier, offer preparation, order/contract execution, and after-sales service of offered goods and services. The Data Controller collects data including, but not limited to: first and last name of a natural person (including business owners), address, tax identification number (NIP), first and last name of a contact person in the company, their position, department, email, and phone number, and in the case of using the Data Controller's websites, also the IP address of the device used by the User. Data is stored by the Data Controller in a format that allows for transfer.

Providing personal data is voluntary but necessary to use selected website functionalities, send offers, fulfill orders, contracts, service, installation, etc.

Disclosure or any other transfer of collected personal data to third parties does not occur unless such data is necessary for proper contract execution, handling complaints or warranty claims, or sending catalogs by traditional mail. This concerns, in particular, transport, shipping, courier, installation, and service companies.

The Data Controller also declares that it entrusts the storage and/or processing of personal data mentioned in this Privacy Policy, based on a written agreement, to entities providing services for the Data Controller, including hosting, automated marketing, and optimization of the Data Controller's websites.

Regardless of the above, if the User of the Service gives separate consent, their personal data is processed for the purpose of receiving commercial information, in particular sending the ordered newsletter to the indicated email address.

VI. Automatically Collected Data

The Data Controller informs that while using its websites, data is also collected automatically. These data may be collected via Cookies and automated marketing systems.

From the moment the User connects to the Service, system logs of the Service record information including the IP address and type of the User's device. The Data Controller informs that, in accordance with the law, it also processes data such as IP address, device type, connection time, and other operational data regarding User activity on the Service. These data are processed for technical purposes to adapt the Service to the needs of Users and to collect general statistical information about the functioning of the Service.

The Data Controller uses Cookies to:

The User can at any time modify settings regarding sharing their location and Cookies, specifying conditions for storage and access by Cookies. Changes can be made through the web browser settings. These settings can block automatic handling of Cookies or notify about each placement on the User's device. Detailed information is available in the browser settings.

The User may delete Cookies at any time using functions available in the web browser. Limiting the use of Cookies may affect some functionalities available on the website.

VII. Rights of Data Subjects

Anyone whose personal data is collected may request from the Data Controller:

  • data portability

The User also has the right to lodge a complaint with the supervisory authority (President of the Personal Data Protection Office) if they consider that the processing of personal data violates applicable law.
